Terms and conditions on which Howarth Timber 175 Anniversary Prize Draw scratch cards are provided.

1. These terms and conditions govern participation in the competition to celebrate the 175th anniversary of the establishment of Howarth Timber. By participating in the competition it is accepted and deemed that these terms and conditions apply.

2. When a purchase of goods with a net purchase value of £50 (£60 including VAT) or more (“qualifying purchase”) is made at a Howarth Timber & Building Supplies Limited (“Howarth”) outlet (“branch”) one scratch card (“card”) only will be given to the person or persons or entity (“person”) making the purchase. An order made for delivery to site to be undertaken by Howarth will not be a qualifying purchase and a person making such a purchase will not be provided with or entitled to a card.

3. Although a card is provided when a qualifying purchase is made the card is not provided pursuant to any contract between the parties and Howarth retains an absolute discretion as to whether to provide a card when a qualifying purchase is made.

4. Each person is limited to one card each day however many qualifying purchases may be made that day.

5. Where the qualifying purchase is made by a person on behalf of some other person the card will be provided:
a. To the person making the purchase as agent (“agent”) for that other person (“principal”);
b. The agent must inform the principal in the event that the agent wins a prize and/or secures an opportunity to win a prize and in any event will hold it as agent for the principal subject to any agreement that the principal and agent may reach in relation thereto. It will be a matter for the agent and principal as to the manner in which the prize is dealt with thereafter and Howarth will not enter into any correspondence and does not accept any liability in relation thereto.
c. In the event that an agent fails to identify him or herself as such and/or a prize is provided to that person of which he or she fails to notify the principal no liability to the principal in respect thereof will attach to Howarth howsoever arising.

6. When the panel indicated on each card is scratched it will either be said “Sorry …You’ve not won a prize this time, but please try again soon” or “Congratulations” and then one of the following forms of words: “you’ve won a box of 200 4 x 50mm spax screws ask in branch for your prize now”; “you’ve won a sharpie pen ask in branch for your prize now”; “you’ve won a tube of pinkgrip adhesive ask in branch for your prize now”; “you’ve won a tape measure ask in branch for your prize now”; “you’ve won a tube of silicone sealant ask in branch for your prize now”; “you’ve won a handsaw ask in branch for your prize now”; “you’ve won an experience day ask in branch how to redeem” (“experience prize); “you’re in the draw for the main prize an Iveco Daily van worth over £25,000 visit www.175years.co.uk for more details” (“main prize”).

7. In order to be eligible for any prize and/or to redeem any such prize it is necessary that:

a. information sought on the card be accurately provided: that information includes the name of the purchaser, the address of the purchaser, a contact number and an email address. In the event that the person making the purchase is agent the particulars of the principal must be provided;
b. The card must be presented to the branch which supplied the card before 5.00pm on 16 October 2015.

8. In the event that the card indicates that one of the prizes other than the experience prize or the main prize has been won the card is to be handed to a sales assistant in the branch which supplied the card. The person handing in the card will be provided with the prize indicated or with goods to an equivalent value. If it is not handed to the sales assistant at the time of purchase of the goods giving rise to the supply of the card proof of a qualifying purchase may be required.

9. In the event that the card indicates the experience prize:
a. The card is to be handed to a sales assistant in the branch which supplied the card. If it is not handed to the sales assistant at the time of purchase of the goods giving rise to the supply of the card proof of a qualifying purchase may be required.
b. The sales assistant will provide information as to how the experience prize is to be realised.
c. The experience prize will be provided by a third party and Howarth will accept no liability in relation thereto whether for any injury or other loss howsoever arising from undertaking the experience whether by reason of negligence of the supplier of the experience or otherwise.
d. An experience prize must be taken and used by 5.00pm on 30 June 2016.

10. In the event that the card indicates the main prize:
a. The card is to be handed to a sales assistant in the branch which supplied the card. If it is not handed to the sales assistant at the time of purchase of the goods giving rise to the supply of the card proof of a qualifying purchase may be required.
b. The card will be submitted for inclusion in a draw from cards indicating that the card is to be placed in a draw for the main prize.
c. The draw will take place during the course of the Howarth Trade Show which is to take place on Friday 13 November 2015 at Elland Road Conference Centre, Leeds United Football Club or as otherwise decided by Howarth.
d. The draw will take place in a manner decided by Howarth. The decision of Howarth as to the winner of the draw will be final and subject to no appeal and Howarth will not enter into any correspondence in respect thereof. Such decisions may include a decision to conduct the draw again.
e. The person who wins the main prize, an Iveco Daily van, with Howarth livery and wrap upon it (“the van”) registered and taxed in March 2015:
i. May be required to provide proof of his, her or its identity to the satisfaction of those supervising the conduct of the draw for Howarth and his or her authority to receive the van.
ii. Must ensure that insurance complying with all relevant legislation is in place before the van is driven.
iii. Must retain the van for at least one year with Howarth’s livery and wrap remaining on it and not alter during that period the appearance of the van, save that there will be a place for the addition of the winner’s own livery, logo or company/entity/trading name and Howarth will bear the reasonable cost of the addition of that material by Northern Truck & Van at their Hull Depot.
iv. Northern Truck & Van will remove the Howarth livery and wrap after the passage of 12 months from the date of collection of the van so long as they are asked to do so by end of December 2016.
v. Will be responsible for delivering the van to Northern Truck & Van at their own expense.

11. Howarth cannot be held responsible in the event that a card is lost or stolen. No replacement will be provided without a further qualifying purchase.

12. Howarth may use all information provided on cards for promotional or other business activities.

13. Howarth may at their absolute discretion: exclude a person or entity from receiving a prize or from the draw for the main prize; refuse to provide a prize to a person claiming to be entitled to prize. It is not necessary that a reason be provided for such exclusion or refusal and no reason will be provided.

14. There are only 175,000 cards. Howarth will cease to give cards in respect of a qualifying purchase made at 5pm on Friday 16 October 2015 or when all the cards have been distributed whichever shall first occur.
